The EU Agency for the Cooperation of Energy Regulators (ACER) has published the outcome of the 2021 roundtable meetings on REMIT data reporting, the 26th edition of the Questions and Answers (Q&As) on REMIT, and an "Open Letter on the extension of the possibility to disclose inside information through corporate websites as a backup solution in case of platform unavailability".

Outcome of the 2021 roundtable meetings on REMIT data reporting

ACER has published the minutes of the latest roundtable meetings – held virtually on 16 and 18 November 2021 – with representatives from organised market places, registered reporting mechanisms, inside information platforms and associations of energy market participants. The minutes reflect the lively discussions on the accomplishments related to REMIT activities, the relevance of present and future challenges, and the next steps to be taken.

The REMIT roundtable meetings –usually held once a year – allow ACER and stakeholders to check in on the state of play of REMIT-related topics and report, discuss and consult on any outstanding issues. The recent meetings were, in particular, an opportunity for ACER to share the latest updates on REMIT data collection, as well as to discuss the ongoing consultation on the updated versions of the transaction reporting guidance and the electronic schemas.

New edition of Q&As on REMIT

ACER also publishes today the 26th edition of the Q&As on REMIT.  It contains the most up-to-date information on REMIT policy issues and it is the result of cooperation with national regulatory authorities (NRAs). It contains new information on the registration of market participants under REMIT, as well as an update on the adoption of backup solutions when dealing with the disclosure of inside information. The Q&As reflect the discussions held with stakeholders during specific events – such as webinars and roundtable meetings – as well as interactions via the REMIT Query form.

New open letter on disclosing inside information

The newly published open letter on the extension of the disclosure of inside information through corporate websites as a backup solution in case of platform unavailability announces ACER’s decision to extend – until 31 December 2022 – the possibility for market participants to publish inside information on their own corporate website as a backup solution.

The decision was triggered by the monitoring of the relevant requirements, consultations with the NRAs, and discussions with market participants during the roundtable meetings 2021. The ACER Guidance on the application of REMIT stipulates that in case an inside information platform (IIP) is temporarily unavailable, a market participant shall refer to a backup solution provided by the IIP. As indicated in the Open Letter, such an exceptional condition may apply only insofar as the website used as a backup solution fulfils the relevant minimum data quality requirements in accordance with the ACER Guidance on REMIT.

ACER to request further information to reinforce the monitoring of the European single intraday coupling market

What is it about?

The EU Agency for the Cooperation of Energy Regulators (ACER) has initiated the procedure for requesting further information to Nominated Electricity Market Operators (NEMOs) operating in the Single Intraday Coupling (SIDC) market.

The information is needed for reconstructing the trading dynamic and the local view of the Shared Order Book in the SIDC market and thus for allowing ACER to fully comply with its mandate of monitoring the wholesale energy markets pursuant Article 7 of REMIT.

What are the next steps?

ACER intends to reach a decision by the end of January 2022. To take an informed decision, ACER will consult involved parties in the course of November 2021.

What are the benefits?

Providing ACER with the relevant information allows the Agency to monitor effectively the European wholesale market’s integrity and transparency, particularly the Single Intraday market, according to REMIT.  

Deterring market participants from manipulating the market, ensuring trust in the functioning of the markets and fostering market integration have the ultimate goal of protecting the interest of companies and consumers.

25th of October 2021 marked the 10th anniversary of the Regulation on Wholesale Energy Market Integrity and Transparency (REMIT), which came into force in 2011 to support open and fair competition in the European wholesale energy markets.

The massive decarbonisation of the European energy system will increasingly rely on more integrated energy markets. Otherwise, the cost of the transition is likely to be much higher, endangering social acceptance. One aspect often overlooked of such further reliance on integrated energy markets is the ability to have trust in these markets, ensuring they are free of manipulation and other damaging trading behaviour. This is the contribution of REMIT, the most advanced energy market monitoring effort on the planet. As such, making sure REMIT evolves alongside energy system change in Europe is the ‘political corollary’ of relying on the further integration of energy markets across Member States to secure the objectives set at the highest levels of government.

What was the REMIT Forum 2021 about?

In the past 10 years of REMIT, ACER have successfully implemented practically all the pieces of the regulation. However, as the REMIT landscape continues to develop, there may eventually be a call for revision and changes. With a series of events in October 2021, ACER aimed to reflect back and to provide a high-level forum to discuss the future.

What format did the REMIT Forum 2021 take?

The 5th REMIT Forum was organised as a series of virtual events: on 25 October an introductory webinar to REMIT was followed by the main plenary session, which fostered a high level political discussion among key stakeholders. On 26 and 28 October, the Forum provided special interest groups sessions on data, reporting and technology as well as on the ACER Guidance.

This open and free webinar provided the first step for newcomers to better understand REMIT and a gateway to further explore the integrity and transparency of EU wholesale energy markets. The webinar aimed to introduce the concept of REMIT to researchers, journalists and all other interested public. It served as a warm up prior to the main event.

The session included a broad range of content, from keynotes to panel discussions, and was not dedicated to a specific REMIT mandate. The purpose was to celebrate 10 years of REMIT by looking back, what was achieved, where are the issues and looking forward - what should be done to improve the regulatory regime. The panel addressed these three questions:

  • What are the key challenges in REMIT in the next 2-3 years?
  • How can this challenges be best addressed?
  • Who should act on these challenges and how?

REMIT Quarterly

​First published in March 2015, the REMIT Quarterly is ACER's main channel of communication with stakeholders on REMIT-related matters. It primarily provides updates on ACER's activities, as well as guidance on the application of the REMIT framework and data reporting.

The REMIT Quarterly also reports any assessments of the operation and transparency of different categories of organised market places and ways of trading, in accordance with Article 7(3) of REMIT.

The REMIT Quarterly is published each quarter on ACER's REMIT Portal. ​

ACER periodic reports

REMIT Annual Reports

​In accordance with Article 7(3) of REMIT, ACER shall assess on an annual basis the operation and transparency of different categories of organised market places (OMPs) and ways of trading.

The REMIT Annual Report was discontinued in 2017. Ever since, ACER reports its transparency assessments through the REMIT Quarterly instead.​
